This is a trade promotion. Please
review the terms and conditions appearing below before submitting your entry and participating in the
Snap-on Superspeedway Pay Dirt Sweepstakes (“Sweepstakes”) described below.
By submitting entries, you agree to accept and be bound by all the terms and
conditions set forth in the Official Rules without any modification or reservation of whatsoever nature,
except as expressly permitted herein. Should you disagree with any or all of the terms and conditions below
or desire not to be bound by them, DO NOT PARTICIPATE in the Sweepstakes in any manner.
- SPONSOR: Snap-on Tools of Canada Co.,
located at 6500 Millcreek Drive, Mississauga, Ontario, L5N 2W6, Canada (“Sponsor”).
- NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF
WINNING.
- SWEEPSTAKES PERIOD: All entries must
be received by Sponsor, where applicable, beginning May 1st, 2023 at 12:00:01 A.M. Central Time
(“CT”) and ending June 9th, 2023 at
11:59:59 P.M. CT ("Sweepstakes Period"). Sponsor is the official timekeeper for the
Sweepstakes.
- ELIGIBILITY: The Sweepstakes is open
and offered to customers of a participating Sponsor franchisee (“Franchisee”) or sales
representative, who are legal residents of Canada, who have reached the age of majority in their
province or territory of residence as of the date of entry ("Participants"). Employees,
representative, agents, officers and directors of Sponsor, its parent and each of its affiliates (as
used in these Official Rules, "affiliate" means any legal entity controlling, controlled by,
or under common control with a party), subsidiaries, independent representatives, franchisees,
advertising, public relations and sweepstakes/sweepstakes agencies, Webmasters/suppliers as well as
members of the immediate family (spouse, children, siblings, parents) of any of the above and those
domiciled (whether or not related) with any of the above are ineligible to enter. To the extent a
Participant is participating during working hours, each Participant warrants and represents that
Participant's employer's policy permits participating and accepting prizes in trade sweepstakes.
By participating, each Participant agrees to these Official Rules and the decisions of Sponsor which are
final and binding in all respects. Entries which do not conform to these Official Rules will be
disqualified, as determined by Sponsor in its sole discretion. Void where prohibited. For a complete
list of Franchisees and Representatives is available by mailing a request to: Snap-on Tools Company LLC,

- ODDS: Odds of winning depends on the
total number of eligible entries received during the Sweepstakes Period.
- TO ENTER: (A) Sweepstakes Entry Card:
An entry consists of an official Sweepstakes Card that contains the Sponsor’s designated web url
www.snapon.com/toronto (“Website”) and a code that must be entered on the Website
(“Entry Card”). Entry Cards are obtained from a Franchisee or sales representative during
the Sweepstakes Period. Participants obtain an Entry Card by making payments on their account in
accordance with a payment schedule determined in their Franchisee’s or sales
representative’s sole discretion. There is no limit on the number of Entries that each Participant
may submit, but eligible Entry Card must apply to separate payments made during the Sweepstakes Period.
(B) Alternate Entry: As an alternative form of entry, a Participant may enter the Sweepstakes by mailing
a 3”x5” index card each week for four (4) consecutive weeks to: Snap-on Tools Company LLC,
ATTN: Gerry Beronja, 2801 80th Street, Kenosha, WI USA, 53143. The index card must contain the following
handwritten information (photocopies of handwriting is prohibited) to be a qualifying index card:
Participant’s name, address, phone number and e-mail and first and last name of
Participant’s Franchisee or sales representative. Once qualifying index cards have been received
for four (4) consecutive weeks, the Participant will receive one entry in the Sweepstakes. There is no
limit on the number of entries that each Participant may submit.
- PRIZES/DRAWINGS: All Participants
submitting a valid entry during the date ranges below will be entered into the drawing.
- Snap-on Superspeedway Pay Dirt: Winner and one guest receive
travel, lodging and tickets to the 2023 HONDA INDY Race. Prize valued at $5,000 Canadian Dollars
(“CAD”), includes roundtrip airfare for the winner and one guest to Toronto, ON, lodging for
three nights (double-occupancy; inclusive of room rate and related taxes only), and food and beverage
voucher (“Indy Experience Prize”). There will be five (5) Honda Indy Adventure prizes
awarded.

- Once a Participant’s entry is chosen, such Participant becomes a
“Potential Winner”. The prizes are not redeemable for cash, exchangeable, transferable, for
resale and not refundable, except at the Sponsor’s sole discretion. 2023 Honda Indy Race tickets
are subject to certain terms and conditions as specified by issuer. Winner agrees that the tickets are
awarded pursuant to a revocable, nontransferable license that is personal to the winner and may not be
sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away,
donated, or otherwise conveyed. Winner must comply with all venue and event rules and regulations,
including execution of all required releases. Failure to do so may result in forfeiture of such
portion(s) of prize. The prizes must be accepted as awarded with no substitutions, except at
Sponsor’s sole discretion. Where applicable, the winners must travel and return to the closest
international airport to the winner’s residence (as determined by Sponsor). Sponsor reserves the
right to determine accommodations, routing and itinerary. Sponsor is not responsible for cancelled,
delayed, suspended or rescheduled events or prize elements (including flights) or if the winner is
denied the ability to fly out of or otherwise travel from or into any particular airport or location for
any reason, whether due to airport or other travel restrictions, lack of required travel documents or
otherwise. Sponsor will not replace any lost or stolen flight tickets or travel vouchers.
- RESTRICTIONS FOR ALL PRIZES: If a
Potential Winner is disqualified or cannot accept a prize as stated in its entirety for any reason, the
prize will be forfeited and a new Potential Winner will be chosen in accordance with the Official Rules.
Once the Potential Winner’s eligibility for a prize is verified and s/he has satisfied all of the
conditions set out in these Official Rules, the prize will be awarded to that Potential Winner and s/he
will become an “Official Winner”. All federal and provincial, taxes, and export or import
duties, and other like fees or charges on any prize or element of a prize (as applicable) are the sole
responsibility of the Official Winner. Each Official Winner agrees that Sponsor may withhold any tax,
duty or other withholding that may be required by law, as determined by Sponsor. What is not expressly
included in the prize description is excluded therefrom. Cost and expenses incurred by the winner other
than those expressly in the prize description are the exclusive responsibility of the winner, including,
but not limited to, any additional airport and/or hotel fees collected at the destination, airport
parking, checked baggage fees, excess baggage fees, insurance, meals and beverages (other than as
expressly included in the prize), gratuities, personal expenses, activities and any fees for any
required travel documents. No more than the number of prizes set forth in the Official Rules will be
awarded. Each Official Winner must provide a valid mailing address for his/her prize to be issued.
Sponsor will mail prize-related information to the Official Winners at such address provided by Official
Winners.
- PRIZE CLAIMS / NOTIFICATION / WINNER: Potential Winners will be notified by phone, in person, mail, overnight mail, email or
in such other manner as determined by Sponsor on or by the dates shown in the table above. Except to the
extent prohibited by law, Potential Winners will be required to complete, sign and return a
certification of eligibility, a liability release and, where lawful, a publicity release within seven
(7) days of receipt of the documents.
Before Potential Winner can become an Official Winner, such Potential Winner
must correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by
Sponsor in person, by telephone or by e-mail. If documents are not returned with the aforementioned time
period, or if the prize notification or prize is returned as non-deliverable, or if the Potential Winner is
found to be ineligible or otherwise not in compliance with these Official Rules, in Sponsor's sole
discretion, the prize will be forfeited and another Potential Winner selected in accordance with these
Official Rules.
- RELEASE AND INDEMNIFICATION: Except
to the extent prohibited by law, by entering, Participants release and agree to indemnify and hold
harmless Sponsor, its parent company, affiliates, subsidiaries, advertising, public relations,
sweepstakes/Sweepstakes agencies, franchisees, Indianapolis Motor Speedway, LLC, INDYCAR, LLC and all of
their respective officers, employees, directors, representatives and agents (individually and
collectively "Releasees") from and against all liability, claims, actions, or proceedings,
losses, injuries and damages (whether due to negligence or otherwise) to person(s), including death, and
property, or violation of intellectual property rights or personal rights (such as, but not limited to,
copyright, patent, trade name/trademark, and/or rights of privacy or publicity, or defamation, slander
or libel, or portrayal in a false light), or breach or failure of any representation or warranty, due in
whole or in part, directly or indirectly to the acceptance, possession, misuse or use of the prize, or
participation in this Sweepstakes, or participation in any Sweepstakes-related activity.
- PUBLICITY: Except where prohibited by
law, by entering, each Participant grants permission for the use of his/her name and/or business name
and/or photograph/likeness in any advertising or publicity carried out by Sponsor or its agents
worldwide at any time or times in all media now known or hereafter discovered without any additional
compensation, and without notice, review or approval, as solely determined by Sponsor; and each
Participant warrants and represents that s/he has all right and authority to grant such
permission.
- LIMITATIONS OF LIABILITY: Releasees are
not responsible for lost, late, stolen, illegible, incomplete, misdirected, postage due, separated or
non-delivered email, entries or mail; or for lost, interrupted or unavailable satellite, network,
server, Internet Service Provider (ISP), email, Web site or other connections availability,
accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone,
satellite, email or cable hardware, software or lines, or technical failure or programming failure, or
jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software
malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical,
electronic or network, or the incorrect or inaccurate capture of entry or notification of winning, email
or other information or the failure to capture, or loss of, any such or similar information. Releasees
are not responsible for any incorrect or inaccurate information, whether caused by website users, or by
any equipment or programming associated with or utilized in the Sweepstakes, and assume no
responsibility for any error, omission, interruption, deletion, defect or delay in operation or
transmission, communications line failure, theft or destruction or unauthorized access to, or tampering
with or hacking of emails. Sponsor reserves the right, at its sole discretion, to disqualify any
individual it finds to be tampering with the entry process or operation of the Sweepstakes, to be acting
in violation of the terms of the Official Rules or to be acting in a non-sportsmanlike or disruptive
manner, or with intent to threaten, abuse or harass any other person. Any use of robotic, automatic,
macro, programmed, third party or like entry methods will void all such entries by such methods, and
disqualify any Participant using such methods. If, for any reason, Sweepstakes is not capable of running
as planned, as solely determined by Sponsor, by reason of unauthorized intervention, fraud, technical
failures or any other causes which, in the sole opinion of Sponsor, corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves
the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, subject, in
Quebec, to the approval of the Régie des alcools, des courses et des jeux, where required. In
such event, Sponsor reserves the right, at its sole discretion, to determine the winners from entries
received prior to action taken, or as otherwise deemed fair and equitable by Sponsor in its sole
discretion, subject, in Quebec, to the approval of the Régie des alcools, des courses et des
jeux, where required. Any attempt to deliberately damage or undermine the legitimate operation of the
Sweepstakes is unlawful and subject to legal action by Sponsor or its agents.
- DISPUTE RESOLUTION/GOVERNING LAW: Except where prohibited, Participants agree that: (a) any and all disputes, claims and
causes of action arising out of or connected with the Sweepstakes shall be resolved individually,
without resort to any form of class action, and exclusively by an action in the federal courts of the
Eastern District of Wisconsin (or exclusively in Milwaukee County State Court, if the federal courts
lack jurisdiction), except as otherwise expressly stated herein, and (b) any and all claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with
participating in the Sweepstakes but in no event attorneys' fees or disbursements; and (c) under no
circumstances will Participants be permitted to obtain awards for and Participants hereby waive all
rights to claim punitive, incidental and consequential damages and any other damages, other than for
actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise
increased.
Except where prohibited, all issues and questions concerning the construction,
validity, interpretation and enforceability of these Official Rules or the rights and obligations as between
Participants and the Releasees in connection with the Sweepstakes shall be interpreted by Sponsor in its
sole and absolute discretion, and shall be governed by and construed in accordance with the internal laws of
the State of Wisconsin including procedural provisions without giving effect to any choice of law or
conflict of law rules or provisions that would cause the application of any other jurisdiction's
laws.
For Québec residents: Any litigation
respecting the conduct or organization of a publicity contest may be submitted to the Régie des
alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be
submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the
parties reach a settlement.
- LANGUAGES: In the event that these
Official Rules, or any advertising, Sweepstakes, or other written, printed, or graphic material are
presented in a language other than English and there is a discrepancy, inconsistency or interpretation
issue between the English language version and any other language version of these Official Rules or of
any materials, the English version shall prevail, govern and control. In the event there is a
discrepancy or inconsistency between disclosures or other statements contained in any materials and the
terms and conditions of these Official Rules, these Official Rules shall prevail, govern and
control.
- PRIVACY: To participate in this
Sweepstakes, each Participant will be asked to provide personal information, such as Participant’s
name, mailing address, email address, phone number and other personal identifying information. When a
Participant submits his/her personal information to Sponsor, the Participant understands and agrees that
Sponsor, its parent, its subsidiaries and affiliates may transfer, store, and process the
Participant’s personal information in any of the countries in which these entities maintain
offices, including without limitation, the United States of America, and as such, the information may be
subject to foreign laws and may be accessible by foreign governments, courts, law enforcement and
regulatory agencies. Participants’ information is collected for the purpose of administering the
Sweepstakes, notably to ensure the Participant’s eligibility and to contact Participant regarding
the Sweepstakes and/or prizes and is further subject to Sponsor’s privacy policy available
at https://www.snapon.com/EN/Privacy-Policy. Sponsor does not sell Participant’s personal information to third parties without
Participant’s prior consent. Sponsor may use Participant’s phone number or email address to
create a custom audience on social media platform(s). Participant may opt out from such use by
contacting Sponsor in writing with a request to remove Participant’s contact information from such
customer audience list. Beyond such use, only employees of Sponsor, Sponsor’s affiliate, Snap-on
Incorporated, and prize suppliers who are involved in the administration of the Game and the delivery of
prizes will have access to it. Participant’s personal information will be kept at 2801 80th
Street, Kenosha, Wisconsin, 53143, USA, and Participants may request access and/or correction of their
personal information by sending a written request to the above address. Potential Winner’s and
Official Winner’s information will also be provided to Sponsor’s affiliate, Snap-on

Dix (10) grands prix de l’usine d’Algona seront décernés, un (1) par bureau régional aux États-Unis et un (1) au Canada. Le tirage du grand prix de l’usine d’Algona aura lieu le 4 avril 2025 vers 17 h 00 (HC) au siège social du commanditaire.
Lorsque le bulletin d’un participant est choisi, celui-ci devient un « gagnant potentiel ». Les prix ne sont pas monnayables, échangeables, transférables, destinés à la revente et non remboursables, sauf à la seule discrétion du commanditaire. Les prix doivent être acceptés tels quels, sans substitution, sauf à la discrétion du franchisé. Les gagnants doivent voyager et retourner à l’aéroport international le plus proche de leur résidence (tel que déterminé par le commanditaire). Le commanditaire se réserve le droit de déterminer l’hébergement, la route et l’itinéraire. Le commanditaire n’est pas responsable de tout événement ou de tout élément des prix qui sont annulés, retardés, interrompus ou reportés (incluant les vols) ni si le gagnant se voit refuser la possibilité de prendre l’avion ou de se rendre dans un aéroport ou un lieu particulier pour quelque raison que ce soit, que ce soit en raison de restrictions aéroportuaires ou d’autres restrictions de voyage, de l’absence des documents de voyage requis ou pour toute autre raison. Le commanditaire ne remplacera pas les billets d’avion ou les bons de voyage perdus ou volés.
- RESTRICTIONS RELATIVES À TOUS LES PRIX : Si un gagnant potentiel est disqualifié ou s'il ne peut accepter le prix dans son ensemble, peu importe la raison, son prix sera annulé et un nouveau gagnant potentiel sera choisi, conformément au règlement officiel. - RÉCLAMATION DES PRIX/NOTIFICATION/GAGNANT : Les gagnants potentiels seront avisés par téléphone, en personne, par courrier, par courrier recommandé, ou par tout autre moyen choisi par le commanditaire au plus tard aux dates indiquées dans le tableau ci-dessus. Sauf où cela est interdit par la loi, le gagnant potentiel doit remplir, signer et retourner un certificat d'admissibilité, un dégagement de responsabilité et là où cela est permis par la loi, une autorisation publicitaire dans une période de sept jours après la réception des documents.
Résidents canadiens seulement : Si le gagnant potentiel réside au Canada, avant qu’il puisse devenir un gagnant officiel, celui-ci doit répondre correctement et sans aide à une question mathématique posée par le commanditaire au téléphone ou par courriel. Si les documents ne sont pas retournés durant la période susmentionnée, ou si la notification ou le prix sont retournés comme non livrables, ou si le gagnant potentiel est jugé inadmissible ou non conforme à ce règlement officiel, à la discrétion du commanditaire, le prix sera annulé et un autre gagnant potentiel sera choisi conformément à ce règlement officiel.

- PUBLICITÉ : Sauf où cela est interdit par la loi, chaque participant permet l'utilisation de son nom, de son nom commercial ou de son image dans toute publicité réalisée par le commanditaire, ou ses agents dans le monde en tout temps et dans tous les médias maintenant connus ou éventuellement connus sans indemnisation supplémentaire et sans préavis, examen ou autorisation, comme cela est déterminé par le commanditaire; de plus, chaque participant garantit qu'il a le droit d'accorder une telle permission.

Dans un tel cas, le commanditaire se réserve le droit, à sa seule discrétion, de déterminer les gagnants à partir des inscriptions reçues avant les événements, ou d'une autre manière jugée équitable par le commanditaire, à sa seule discrétion, assujettie à l'autorisations de la Régie des alcools, des courses et des jeux au Québec, le cas échéant. Toute tentative délibérée d'endommager ou de nuire au fonctionnement des concours constitue une enfreinte à la loi et sera assujettie à des mesures juridiques par le commanditaire ou ses agents.
- RÉSOLUTION DE LITIGE ET LOI APPLICABLE : Sauf où cela est interdit par la loi, les participants acceptent :(a) que les litiges, réclamations et actions en justice découlant de ces concours ou y étant liés seront résolus individuellement, sans recourir à un recours collectif et exclusivement au moyen d'une action devant les courts d’États ou fédérales de l’Eastern District of Wisconsin (ou exclusivement devant le Milwaukee County State Court si les cours fédérales n’ont pas juridiction, (b) que les réclamations, jugements et indemnisations se limiteront aux coûts réels encourus, y compris les coûts associés à la participation aux concours, mais ne comprenant pas les frais d’avocat; (c) qu’en aucun cas les participants ne pourront être indemnisés en vertu de dommages punitifs, accessoires et consécutifs, autres que les coûts réels; ils renoncent à ces droits ainsi qu’aux droits de multiplier ou d’augmenter les dommages.

Tout litige concernant la remise d’un prix peut être soumis à la Régie des alcools, des courses et des jeux aux seules fins d’en arriver à un règlement entre les parties.
- LANGUES : Advenant le cas où ce règlement officiel, toute publicité, le concours, ou tout autre document écrit, imprimé ou graphique est présenté dans une langue autre que l'anglais et qu'il existe une divergence entre la version anglaise et la version traduite de ce règlement officiel ou de tout autre document, la version anglaise prévaudra. Advenant le cas où il existe des divergences entre les divulgations ou déclarations contenues dans tout document et les conditions de ce règlement officiel, ce règlement officiel prévaudra.

2025 Superspeedway Pay Dirt Sweepstakes (“Sweepstakes”) described below.
By submitting entries, you agree to accept and be bound by all the terms and conditions set forth in the Official Rules without any modification or reservation of whatsoever nature, except as expressly permitted herein. Should you disagree with any or all of the terms and conditions below or desire not to be bound by them, DO NOT PARTICIPATE in the Sweepstakes in any manner.
- SPONSOR: Snap-on Tools Company LLC, a Delaware limited liability company, located at 2801 80th Street, Kenosha, Wisconsin, USA, 53143 (“Sponsor”).
- NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF
WINNING.
- SWEEPSTAKES PERIOD: All entries must be received by Sponsor, where applicable, beginning January 6, 2025 at 12:00:01 A.M. Central Time
(“CT”) and ending April 4, 2025 at 11:59:59 P.M. CT ("Sweepstakes Period"). Sponsor
is the official timekeeper for the Sweepstakes.
- ELIGIBILITY: The Sweepstakes is open and offered to customers of a participating Sponsor franchisee ("Franchisee") or sales representative, who are legal residents of the 50 United States, the District of Columbia or Puerto Rico, or Canada, who have reached the age of majority in their state, province or territory of residence as of the date of entry ("Participants"). Employees, representative, agents, officers and directors of Sponsor, its parent and each of its affiliates (as used in these Official Rules, "affiliate" means any legal entity controlling, controlled by, or under common control with a party), subsidiaries, independent representatives, franchisees, advertising, public relations and sweepstakes/sweepstakes agencies, Webmasters/suppliers as well as members of the immediate family (spouse, children, siblings, parents) of any of the above and those domiciled (whether or not related) with any of the above are ineligible to enter. To the extent a Participant is participating during working hours, each Participant warrants and represents that Participant's employer's policy permits participating and accepting prizes in trade sweepstakes. By participating, each Participant agrees to these Official Rules and the decisions of Sponsor which are final and binding in all respects. Entries which do not conform to these Official Rules will be disqualified, as determined by Sponsor in its sole discretion. Void where prohibited. - ODDS: Odds of winning depends on the
total number of eligible entries received during the Sweepstakes Period.
- TO ENTER: (A) Factory to Finish Line Entry Card: An entry consists of an official Factory to Finish Line Card that contains the Sponsor's designated web url www.snapon.com/factorytofinishline ("Website") and a code that must be entered on the Website ("Entry Card"). Entry Cards are obtained from a Franchisee or sales representative during the Sweepstakes Period. Participants obtain an Entry Card by making payments on their account in accordance with a payment schedule determined in their Franchisee's or sales representative's sole discretion. There is no limit on the number of Entries that each Participant may submit, but eligible Entry Card must apply to separate payments made during the Sweepstakes Period. (B) Alternate Entry: As an alternative form of entry, a Participant may enter the Factory to Finish Line Sweepstakes by mailing a 3"x5" index card each week for four (4) consecutive weeks to: Snap-on Tools Company LLC, ATTN: Joe Yank, 2801 80th Street, Kenosha, WI USA, 53143. The index card must contain the following handwritten information (photocopies of handwriting is prohibited) to be a qualifying index card: Participant's name, address, phone number and e-mail and first and last name of Participant's Franchisee or sales representative. Once qualifying index cards have been received for four (4) consecutive weeks, the Participant will receive one entry in the Sweepstakes. There is no limit on the number of entries that each Participant may submit.

The Algona Plant Grand Prize is valued at approximately ten thousand ($10,000) United States Dollars ("USD") ("Algona Plant Grand Prize"). Once a Participant's entry is chosen, such Participant becomes a "Potential Winner". The prizes are not redeemable for cash, exchangeable, transferable, for resale and not refundable, except at the Sponsor's sole discretion. The prizes must be accepted as awarded with no substitutions, except at Sponsor's sole discretion. Where applicable, the winners must travel and return to the closest international airport to the winner's residence (as determined by Sponsor). Sponsor reserves the right to determine accommodations, routing and itinerary. Sponsor is not responsible for cancelled, delayed, suspended or rescheduled events or prize elements (including flights) or if the winner is denied the ability to fly out of or otherwise travel from or into any particular airport or location for any reason, whether due to airport or other travel restrictions, lack of required travel documents or otherwise. Sponsor will not replace any lost or stolen flight tickets or travel vouchers.
- RESTRICTIONS FOR ALL PRIZES: If a Potential Winner is disqualified or cannot accept a prize as stated in its entirety for any reason, the prize will be forfeited and a new Potential Winner will be chosen in accordance with the Official Rules. Once the Potential Winner's eligibility for a prize is verified and s/he has satisfied all of the conditions set out in these Official Rules, the prize will be awarded to that Potential Winner and s/he will become an “Official Winner”. All federal, provincial, state and local taxes, and export or import duties, and other like fees or charges on any prize or element of a prize (as applicable) are the sole responsibility of the Official Winner. Each Official Winner agrees that Sponsor may withhold any tax, duty or other withholding that may be required by law, as determined by Sponsor. What is not expressly included in the prize description is excluded therefrom. Cost and expenses incurred by the winner other than those expressly in the prize description are the exclusive responsibility of the winner, including, but not limited to, any additional airport and/or hotel fees collected at the destination, airport parking, checked baggage fees, excess baggage fees, insurance, meals and beverages (other than as expressly included in the prize), gratuities, personal expenses, activities and any fees for any required travel documents. No more than the number of prizes set forth in the Official Rules will be awarded. Each Official Winner must provide a valid mailing address for his/her prize to be issued. Sponsor will mail prize-related information to the Official Winners at such address provided by Official Winners.
- PRIZE CLAIMS / NOTIFICATION / WINNER: Potential Winners will be notified by phone, in person, mail, overnight mail, email or in such other manner as determined by Sponsor on or by the dates shown in the table above. Except to the extent prohibited by law, Potential Winners will be required to complete, sign and return a certification of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of receipt of the documents.
Canadian Residents Only: If the Potential Winner is a resident of Canada, before Potential Winner can become an Official Winner, such Potential Winner must correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by Sponsor in person, by telephone or by e-mail. If documents are not returned with the aforementioned time period, or if the prize notification or prize is returned as non-deliverable, or if the Potential Winner is found to be ineligible or otherwise not in compliance with these Official Rules, in Sponsor's sole discretion, the prize will be forfeited and another Potential Winner selected in accordance with these Official Rules.
- RELEASE AND INDEMNIFICATION: Except to the extent prohibited by law, by entering, Participants release and agree to indemnify and hold harmless Sponsor, its parent company, affiliates, subsidiaries, advertising, public relations, sweepstakes/Sweepstakes agencies, franchisees, employees, directors, representatives and agents (individually and collectively “Releasees”) from and against all liability, claims, actions, or proceedings, losses, injuries and damages (whether due to negligence or otherwise) to person(s), including death, and property, or violation of intellectual property rights or personal rights (such as, but not limited to, copyright, patent, trade name/trademark, and/or rights of privacy or publicity, or defamation, slander or libel, or portrayal in a false light), or breach or failure of any representation or warranty, due in whole or in part, directly or indirectly to the acceptance, possession, misuse or use of the prize, or participation in this Sweepstakes, or participation in any Sweepstakes-related activity.
- PUBLICITY: Except where prohibited by law, by entering, each Participant grants permission for the use of his/her name and/or business name and/or photograph/likeness in any advertising or publicity carried out by Sponsor or its agents worldwide at any time or times in all media now known or hereafter discovered without any additional compensation, and without notice, review or approval, as solely determined by Sponsor; and each Participant warrants and represents that s/he has all right and authority to grant such permission.
- LIMITATIONS OF LIABILITY: Releasees are not responsible for lost, late, stolen, illegible, incomplete, misdirected, postage due, separated or non-delivered email, entries or mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), email, Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, email or cable hardware, software or lines, or technical failure or programming failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or notification of winning, email or other information or the failure to capture, or loss of, any such or similar information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in the Sweepstakes, and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of emails. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Sweepstakes, to be acting in violation of the terms of the Official Rules or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any use of robotic, automatic, macro, programmed, third party or like entry methods will void all such entries by such methods, and disqualify any Participant using such methods. If, for any reason, Sweepstakes is not capable of running as planned, as solely determined by Sponsor, by reason of unauthorized intervention, fraud, technical failures or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, subject, in Quebec, to the approval of the Régie des alcools, des courses et des jeux, where required. In such event, Sponsor reserves the right, at its sole discretion, to determine the winners from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor in its sole discretion, subject, in Quebec, to the approval of the Régie des alcools, des courses et des jeux, where required. Any attempt to deliberately damage or undermine the legitimate operation of the Sweepstakes is unlawful and subject to legal action by Sponsor or its agents.
- DISPUTE RESOLUTION/GOVERNING LAW: Except where prohibited, Participants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by an action in the federal courts of the Eastern District of Wisconsin (or exclusively in Milwaukee County State Court, if the federal courts lack jurisdiction), except as otherwise expressly stated herein, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes but in no event attorneys' fees or disbursements; and (c) under no circumstances will Participants be permitted to obtain awards for and Participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between Participants and the Releasees in connection with the Sweepstakes shall be interpreted by Sponsor in its sole and absolute discretion, and shall be governed by and construed in accordance with the internal laws of the State of Wisconsin including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws.
For Québec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
- LANGUAGES: In the event that these Official Rules, or any advertising, Sweepstakes, or other written, printed, or graphic material are presented in a language other than English and there is a discrepancy, inconsistency or interpretation issue between the English language version and any other language version of these Official Rules or of any materials, the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
- PRIVACY: To participate in this Sweepstakes, each Participant will be asked to provide personal information, such as Participant's name, mailing address, email address, phone number and other personal identifying information. When a Participant submits his/her personal information to Sponsor, the Participant understands and agrees that Sponsor, its parent, its subsidiaries and affiliates may transfer, store, and process the Participant's personal information in any of the countries in which these entities maintain offices, including without limitation, the United States of America, and as such, the information may be subject to foreign laws and may be accessible by foreign governments, courts, law enforcement and regulatory agencies. Participants' information is collected for the purpose of administering the Sweepstakes, notably to ensure the Participant's eligibility and to contact Participant regarding the Sweepstakes and/or prizes and is subject to Sponsor's privacy policy available at https://www.snapon.com/EN/Privacy-Policy. Sponsor does not sell Participant's personal information to third parties without Participant's prior consent. Sponsor may use Participant's phone number or email address to create a custom audience on social media platform(s). Participant may opt out from such use by contacting Sponsor in writing with a request to remove Participant's contact information from such customer audience list. Beyond such use, only employees of Sponsor, Sponsor's affiliate, Snap-on Incorporated, and prize suppliers who are involved in the administration of the Game and the delivery of prizes will have access to it. Participant's personal information will be kept at 2801 80th Street, Kenosha, Wisconsin, 53143, USA, and Participants may request access and/or correction of their personal information by sending a written request to the above address. Potential Winner's and Official Winner's information will also be provided to Sponsor's affiliate, Snap-on Incorporated, and kept at 2801 80th Street, Kenosha, Wisconsin, 53143, USA, for the purpose of administering the Sweepstakes. IF PARTICIPANT DOES NOT AGREE WITH ANY OF THE ABOVE OR ANY OTHER PROVISIONS OF OUR PRIVACY POLICY DO NOT ENTER THE SWEEPSTAKES.
